Terms and Conditions

Payment

Master Painters Association ACT agrees to supply membership entitlements to you, the Applicant, for the purpose of benefits to be attributed to the painter or painting business identified within the application form. We agree to confer on you the membership rights in accordance with our rules upon payment of the required membership fee and the applicant’s compliance with the rules and Code of Ethics of the Master Painters Association ACT.

Master Painters Association ACT membership period follows the Australian financial year—1 July to 30 June.

The membership fee for the first year of membership will be determined on a pro rata basis.

Please note that all fees, costs and prices quoted by Master Painters Association ACT on this website are in Australian dollars (AUD$), unless otherwise explicitly stated.

Joining Fee

The Joining Fee is a once off administration charge and is not refundable. Should your membership lapse or be terminated, re-application must be made within 3 months of lapsing or termination or the membership will be considered a new member and will incur the full Joining Fee.

Membership Renewal

Membership renewals will be automatically sent to members for successive 12 month terms (following the Australian financial year) unless the member provides written notice of intent to cancel the membership at least 30 days before the end of the membership period.

Members receive three months to pay their membership fee (due by 30 September each year). If you do not pay your subscription by this due date:

  • Your membership rights will be terminated; and
  • Your membership services will be suspended until payment in full is received.

Refund Policy

Membership Fee Refunds

Master Painters Association ACT does not refund or reimburse any portion of a membership fee.

Product Refunds

Please note that Master Painters Association ACT does not provide refunds on any products for ‘change of mind’ or ‘incorrect purchasing decisions’. As such, ensure that you choose products carefully before making a purchase.

If goods purchased via Master Painters Association ACT are faulty, or do not perform as advertised, we are happy to provide an exchange, a refund, or a credit note.

Membership Entitlements

The range of membership services current at the date of this application is set out at www.masterpaintersactcom.au. Master Painters Association ACT may suspend, vary or withdraw any of these services without notice.

Membership entitlements and benefits are extended to the member and authorised individuals associated with the member, such as employees or contractors.

Specialist Services

Supplemental, specialist and customised products may also be made available, on a fee for service basis, at special rates for members in most cases. Such products may include but are not limited to:

  • Seminars, Workshops and Conferences
  • Training Courses
  • Specialised Services
  • Awards for Excellence Programs
  • Representation and Mediation

To the extent permitted by the law, Master Painters Association ACT excludes all liability including that arising by virtue of any implied conditions or warranties in relation to our services and to the extent that such liability cannot be lawfully excluded under the laws of New South Wales and the Commonwealth of Australia.

Use of Your Personal Data

As part of your membership service, Master Painters Association ACT may use your personal information to:

  • Promote your business through various media such as websites, member directories and the like.
  • Offer you products and services relevant to your business from both MPA and other commercial providers.
  • Send you commercial electronic messages.

Warranties

To the extent of our legal obligations, Master Painters Association ACT excludes all conditions, warranties, guarantees and similar, whether express or implied, as to the condition, suitability, quality, fitness or safety of any goods or services supplied by us, other than those implied by statute which may not be legally excluded. Liabilities we have to you under Warranties, that are implied by statute and cannot be excluded are subject to limitations.

Limitation of Liability

In no event, to the limits of our legal obligation, will Master Painters Association ACT accept responsibility to any party for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from the supply of goods or services via this website or the use of such goods or services by any person, including, without limitation, any lost profits or savings, damage to or loss of property or personal injury (including death), even if we are expressly advised of the possibility of such damages. This waiver of liability applies to all causes of action, whether based on contract, warranty, tort (including negligence) or any other legal theories. In the event of the above exclusion of liability not being enforceable, or deemed invalid or ineffective it will be removed from the above terms and in its place a maximum aggregate liability for damages, losses and other amounts referred to in the above exclusion of liability under any cause of action referred to in the above exclusion of liability is limited to A$5.00.

Indemnity

In engaging with our services, you agree to indemnify, hold and defend our directors, employees, officers, contractors licensors and suppliers harmless from and against all proceedings, expenses, losses, damages and costs (whether special, actual, direct, indirect, consequential, exemplary or incidental) of any nature made by any other party arising or due to the violation of any of these Terms, any terms and policies it incorporates by reference, the rights of another party, any applicable law, statute, ordinance or regulation or due to or arising out of any activity related to goods and services supplied by us.

Applicable Law

Our Terms and Conditions are governed and written in reference to the law of New South Wales, Australia. The parties engaged in our services all submit the to the non-exclusive jurisdiction of the courts of New South Wales and its appellate courts.

Agreement

The Terms and Conditions (including any terms or policies incorporated by reference) form the entirety of the agreement between you and Master Painters Association ACT regarding the matter. This agreement replaces and supersedes all and all prior communications.

Availability of Terms and Conditions

These Terms and Conditions are available upon request. They are reviewed from time to time and any amendments will be included in the updated Terms and Conditions.

Acceptance and Changes to Master Painters Association ACT Terms and Conditions

You acknowledge and accept that your use of the Master Painters Association ACT website indicates your acceptance of the Master Painters Association Terms and Conditions. These are the current Terms and Conditions. They replace any other Terms and Conditions published on Master Painters Association ACT to date. We may, at any time, make amendments to the Terms and Conditions by publishing new Terms and Conditions on the Master Painters Association ACT website. You accept that by doing this, Master Painters Association ACT has provided you with sufficient notice of the amendments. It is your responsibility to check the Terms and Conditions each time you visit the Master Painters Association ACT website.
